Higgins Introduces Legislation to Restrict AI Deployment in the IRS

WASHINGTON (Mar. 19, 2024) – Congressman Clay Higgins (R-LA) and Congressman Eric Burlison (R-MO) introduced the No AI Audits Act, which would restrict the use of Artificial Intelligence (AI) in the IRS’ tax evaluation process and add safeguards to ensure taxpayers are protected from unaccountable audits.
 
“The weaponization of AI technology is an ominous threat to our Constitutional freedoms,” said Congressman Higgins. “Unelected bureaucrats in DC should not be using AI as a tool to further weaponize the federal government against the American people. We, as a Congress who have been sworn to serve the people, must think seriously about the implications of the rapid deployment of AI technology. We must focus on the balance between the power of AI and the dangers it holds for freedom-loving Americans and our national security.”

This legislation would:

  • Require audit selection and initiation to be done by an IRS staff investigator with available contact information.
  • Limits the IRS Commissioner’s authority to implement AI guidance without clear taxpayers’ protections.
  • Conducts a GAO review of AI use at the IRS to bring transparency to any adverse effects of the technology on taxpayer rights.
