Higgins Amendment to Clarify Constitutional Protections, Preserve Law Enforcement Capabilities Passes House

Submitted by United States Representative Clay Higgins of the 3rd District in Louisiana.

WASHINGTON (Apr. 22, 2024) – Congressman Clay Higgins (R-LA) introduced an amendment that passed by voice on the House Floor to H.R. 4639, the Fourth Amendment Is Not For Sale Act (FANFSA). This amendment was crafted to provide clarity requested by law enforcement organizations and plainly states that FANFSA would not apply to data/information made reasonably available to the public or voluntarily offered with consent. This includes user-generated public content (social media), public records, background checks, and Automatic License Plate Readers (ALPR). Law enforcement uses this data regularly to safeguard public safety.
 
“The core principles of our representative Republic are clear. Every American deserves individual rights, liberties, freedoms, and privacies and Congress shall protect those rights,” said Congressman Higgins. “My primary oath is to protect and defend the Constitution of the United States. My amendment addresses, in good faith, the concerns that my brothers and sisters of the Thin Blue Line have voiced in accordance with a plain reading of the Fourth Amendment.”
